Pyle Technologies, Inc. ("Pyle," "we," "our," or "us") is committed to protecting your privacy. This Privacy Policy explains how your personal information is collected, used, and disclosed by Pyle when you use our mobile application ("App"), website at www.getpyle.com ("Website"), and related services (collectively, the "Services").

By accessing or using our Services, you signify that you have read, understood, and agree to our collection, storage, use, and disclosure of your personal information as described in this Privacy Policy.

2. Information We Collect

We collect several types of information from and about users of our Services, including:

2.1 Information You Provide to Us

  • Account Information: When you create an account, we collect your name, email address, password, and other information you provide during the registration process.
  • Gift Card Information: We collect information about your gift cards, including the card number, PIN, balance, issuing merchant, and expiration date.
  • Profile Information: If you choose to add profile information, we collect information you provide in your profile, such as your profile picture.
  • Communications: If you contact us directly, we may receive additional information about you, such as your name, email address, the contents of your message, and any other information you choose to provide.

2.2 Information We Collect Automatically

  • Device Information: We collect information about the device you use to access our Services, including the hardware model, operating system and version, unique device identifiers, and mobile network information.
  • Usage Information: We collect information about your use of our Services, such as the time and duration of your use, the features you interact with, and other actions you take within the App or Website.

2.3 Information from Third Parties

We may receive information about you from third parties, such as other users who invite you to use our Services, merchants who issue gift cards, or service providers who help us validate gift card information.

3. How We Use Your Information

We use the information we collect to:

  • Provide, maintain, and improve our Services;
  • Process and complete any necessary transactions;
  • Send technical notices, updates, security alerts, and support and administrative messages;
  • Respond to your comments, questions, and requests, and provide customer service;
  • Communicate with you about products, services, offers, promotions, and events, and provide other news or information about us and our partners;
  • Monitor and analyze trends, usage, and activities in connection with our Services;
  • Detect, investigate, and prevent fraudulent transactions and other illegal activities, and protect the rights and property of Pyle and others;
  • Personalize and improve the Services, and provide content, features, or advertisements that match your interests and preferences; and
  • Carry out any other purpose described to you at the time the information was collected.

4. Information Sharing and Disclosure

We may share information about you as follows:

4.1 With Service Providers

We may share your information with third-party vendors, consultants, and other service providers who need access to such information to carry out work on our behalf, such as hosting providers and analytics services.

4.2 For Legal Reasons

We may disclose your information if we believe that disclosure is reasonably necessary to comply with a law, regulation, legal process, or governmental request; to protect the safety, rights, or property of Pyle, our users, or the public; and to detect, prevent, or otherwise address fraud, security, or technical issues.

4.3 In Connection with Business Transfers

We may share or transfer your information in connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business to another company.

4.4 With Your Consent

We may share your information with third parties when you give us your consent to do so.

4.5 Aggregated or De-Identified Information

We may share aggregated or de-identified information, which cannot reasonably be used to identify you, with third parties.

We do not sell your personal information to third parties.

5. Data Storage and Security

We use commercially reasonable safeguards to preserve the integrity and security of information collected through our Services. However, no security system is impenetrable, and we cannot guarantee the security of our systems 100%. In the event that any information under our control is compromised as a result of a breach of security, we will take reasonable steps to investigate the situation and, where appropriate, notify those individuals whose information may have been compromised and take other steps, in accordance with any applicable laws and regulations.

5.1 Data Retention

We store the information we collect about you for as long as is necessary for the purpose(s) for which we collected it or for other legitimate business purposes, including to meet our legal, regulatory, or other compliance obligations.

5.2 Data Security Implementation

We utilize Google Firebase's secure cloud infrastructure to store your information, including gift card data. All sensitive gift card information (including card numbers and PINs) is encrypted when stored using industry-standard encryption methods. We implement appropriate technical and organizational measures to protect your personal information against unauthorized or unlawful processing, accidental loss, destruction, or damage.

5.3 Account Deletion

When you delete your account, we will delete your personal information and gift card data within 30 days. However, we may retain certain information as required by law or for legitimate business purposes, such as to resolve disputes, enforce our agreements, or for backup purposes. Any retained information will be handled in accordance with this Privacy Policy.

6. User Rights and Choices

6.1 Account Information

You may update, correct, or delete your account information at any time by logging into your account or by contacting us. Please note that we may retain certain information as required by law or for legitimate business purposes.

6.3 Push Notifications

With your consent, we may send push notifications to your mobile device. You can deactivate these notifications by changing your notification settings within the App or through your device settings.

6.4 Marketing Communications

You can opt out of receiving promotional communications from us by following the instructions in those communications or by contacting us. If you opt out, we may still send you non-promotional communications, such as those about your account or our ongoing business relations.

6.5 Cookies and Similar Technologies

Most web browsers are set to accept cookies by default. If you prefer, you can usually choose to set your browser to remove or reject browser cookies. Please note that if you choose to remove or reject cookies, this could affect the availability and functionality of our Website.

6.6 Your California Privacy Rights

If you are a California resident, the California Consumer Privacy Act ("CCPA") gives you the right to request access to and deletion of the personal information we have collected about you. To submit a request, please contact us at privacy@getpyle.com.

6.7 Geographic Availability

Our Services are designed for users in the United States only. We do not offer our Services to users outside the United States at this time.

6.8 Do Not Track Signals

Some browsers have incorporated "Do Not Track" (DNT) features that can send a signal to the websites you visit indicating you do not wish to be tracked. Because there is not yet a common understanding of how to interpret the DNT signal, our Services do not currently respond to browser DNT signals. Instead, you can use the range of other tools we provide to control data collection and use, including the ability to opt out of receiving marketing from us as described above.

7. Children's Privacy

Our Services are not directed to children under the age of 13, and we do not knowingly collect personal information from children under the age of 13. If we learn that we have collected personal information from a child under the age of 13, we will promptly delete that information. If you believe we have collected personal information from a child under the age of 13, please contact us.

8. Changes to the Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes to this Privacy Policy, we will notify you by email, through the Services, or by other means as required by applicable law. Your continued use of the Services after the effective date of the revised Privacy Policy constitutes your acceptance of the revised terms.

9. Platform-Specific Provisions

9.1 Apple App Store

As required by Apple's App Store Review Guidelines, we confirm that:

  • We do not use or collect data for tracking purposes as defined by Apple.
  • If you choose to opt out of tracking, we will respect your choice and will not track your activities across other companies' apps or websites.
  • Any third-party code used in our App that collects information is subject to this Privacy Policy.

9.2 Google Play Store

As required by Google's Developer Program Policies, we confirm that:

  • We handle your personal information securely and only use it for the purposes stated in this Privacy Policy.
  • We obtain your consent before collecting sensitive information as defined by Google.
  • We provide clear and truthful information about how we use the permissions requested by our App.

10. App Permissions

Our App may request certain permissions on your device to provide its core functionality. These permissions include:

  • Camera Access: Used to scan gift card barcodes.
  • Photo Library Access: Used to upload profile pictures.
  • Notification Permissions: Used to send you reminders and important updates about your gift cards.

You can manage these permissions through your device settings. Disabling certain permissions may limit the functionality of the App.

11. Data Breach Notification

In the event of a data breach that compromises your personal information, we will notify affected users promptly and without unreasonable delay. Our notification will include information about what happened, what information was involved, steps we're taking to mitigate harm, and additional steps you can take to protect yourself, as applicable under relevant laws and regulations.
