Terms of Service

Welcome to Pyle! These Terms and Conditions ("Terms") govern your access to and use of our platform, services, and applications (collectively, the "Services"). By accessing or using our Services, you agree to be bound by these Terms. If you do not agree with these Terms, please do not use our Services.

1. Acceptance of Terms

By creating an account, downloading the app, or otherwise using the Services, you agree to these Terms and our Privacy Policy. If you do not agree to any part of these Terms, you may not use the Services.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) to use the Services. By using Pyle, you represent and warrant that you meet these eligibility requirements.

3. Account Registration and Security

  1. Account Creation: You may need to create an account to access certain features of the Services. You are responsible for ensuring the accuracy of the information you provide.
  2. Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately of any unauthorized use or security breach.
  3. Termination: We reserve the right to suspend or terminate your account for any reason, including violation of these Terms.

4. Permitted Use of the Services

You agree to use the Services only for lawful purposes and in compliance with these Terms. You may not:

  • Use the Services for any unlawful, fraudulent, or malicious activity.
  • Interfere with or disrupt the functionality of the Services.
  • Reverse-engineer, decompile, or disassemble the Services.

5. Fees and Payments

  1. Subscription Services: Pyle Plus is a subscription-based service available through the app. By subscribing to Pyle Plus, you agree to pay the applicable subscription fees, which are billed through the app store (e.g., Apple App Store, Google Play Store) associated with your device. Subscription fees and terms are displayed at the point of purchase.
  2. Payment Processing: Payments for Pyle Plus are managed by the respective app store. By completing a subscription purchase, you agree to the app store’s payment terms, policies, and conditions.
  3. Auto-Renewal: Subscriptions automatically renew at the end of each billing cycle unless canceled at least [24 hours] before the renewal date. You can manage or cancel your subscription directly through your app store account settings.
  4. Refunds: All payments for subscriptions are final. Refunds are processed solely at the discretion of the app store, subject to their respective refund policies. Pyle cannot directly issue refunds or manage disputes regarding payments made through app stores.
  5. Changes to Pricing: We reserve the right to change subscription fees at any time. If the subscription price increases, you will be notified in advance, and the new rate will apply to the next billing cycle after notification. Continued use of Pyle Plus after the change constitutes acceptance of the updated pricing.
  6. Free Trials: If offered, free trials are valid for a limited time and may automatically convert to a paid subscription unless canceled before the trial period ends. Users may not qualify for multiple free trials.

6. Intellectual Property

  1. Ownership: All content, trademarks, and intellectual property in the Services are owned by Pyle or its licensors.
  2. License: We grant you a limited, non-exclusive, and revocable license to use the Services as intended. You may not reproduce, distribute, or create derivative works based on our content without our permission.

7. Privacy

Our Privacy Policy explains how we collect, use, and protect your data. By using the Services, you consent to the practices described in the Privacy Policy.

8. Third-Party Services and Links

The Services may include links to third-party websites or services. We are not responsible for the content, policies, or practices of these third parties.

9. Disclaimer of Warranties

The Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.

10. Limitation of Liability

To the extent permitted by law, Pyle will not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Services.

11. Indemnification

You agree to indemnify and hold harmless Pyle, its affiliates, and employees from any claims, damages, or expenses resulting from your use of the Services or violation of these Terms.

12. Dispute Resolution

  1. Governing Law: These Terms are governed by the laws of Delaware.
  2. Arbitration: Any disputes arising under these Terms will be resolved through binding arbitration in Delaware, rather than in court, except for small claims.

13. Changes to Terms

We may update these Terms from time to time. If we make material changes, we will notify you through the Services or by other means. Continued use of the Services after the changes become effective constitutes your acceptance.
